TERMS AND CONDITIONS
Please read carefully the terms and conditions below before proceeding to the Booking Form.
1. DEFINITIONS
1.1 Booking:
The Booking Form made by you which is accepted by us in accordance with these terms and conditions.
1.2 Force Majeure:
Unusual and unforeseeable circumstances beyond our control, the circumstances of which neither we nor our suppliers could avoid. Examples of which are war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or industrial disaster, fire, adverse weather conditions, level of water in rivers, technical or maintenance problems to transport, staff cancellations, or other similar events beyond Sanasuma’s control.
1.3 Major change:
One made before departure that involves a change in your resort area overseas, or a change in the type and standard of accommodation to that which you had booked.
1.4 Minor change:
Any change apart from a Major change.
1.5 The Retreat:
Sanasuma Retreat held at Galapita.
1.6 Underbooking:
Circumstances where the number of guests who have booked the Retreat is less than the minimum required, in our view, to make it commercially viable.
1.7 We, our, ourselves us:

1.8 You, your, yourself, guest:
Any person who completes a Booking Form, either directly (as principal) or indirectly (on behalf of another beneficiary) with us.
2. CONTRACT
2.1 These terms and conditions govern all contracts you make with us.
2.2 No contract shall come into existence between us until:
(a) we accept your Booking Form. For each Booking Form you must:
(i) provide us with all information which we require; and
(ii) ensure that all information which you provide to us in your Booking Form is accurate and correct; and
(b) we have received the appropriate deposit or full payment from you and you must ensure that the method of payment you are using is your own (or if it is a third party’s you have their express authorisation, as confirmed to us in advance in writing), and that sufficient funds are available to cover the cost of the Retreat which you book with us, and;
(c) a confirmation invoice has been issued.
2.3 We reserve the right to refuse, at our sole discretion, any Booking Form you place with us.
3. PAYMENT:
3.1 The Retreat which we advertise, is subject to availability.
3.2 By submitting your Booking Form to us you guarantee that you have the authority to accept (and do accept) these terms and conditions on your behalf and on behalf of all members of your party.
3.3 If you are completing Booking Forms on behalf of others beside yourself, we shall take it that you have the authority of each of those people to enter into that contract and that you and they have agreed to be jointly and severally liable to us.
3.4 We require a minimum deposit of £100 from you within 7 days of our confirmation of acceptance of your Booking Form. For Booking Forms submitted 8 weeks or less before departure please see 3.7.
3.5 When we receive your Booking Form we shall send you a "booking reference" which you must quote in all future correspondence with us.
3.6 If we cannot or do not accept your Booking Form we shall notify you accordingly.
3.7 If you are completing a Booking Form 8 weeks or less before departure, full payment will be necessary within 7 days of our acceptance of the Booking Form.
3.8 Sanasuma reserves the right to cancel any booking for which full payment has not been received 8 weeks before departure, and to levy cancellation charges.
4. PAYMENT METHOD
4.1 We accept payment by:
(a) personal or Company cheque made payable to "Ms Fiona Raymond"and we require 7 business days to clear payments made by cheque
(b) personal or Company bank transfer.
(c) Pay pal.
(d) cash is not accepted. Please note that we do not accept responsibility for cash sent by courier, or post, even if sent by registered, recorded post or special delivery;
5. EXCLUSIONS
5.1 We do not accept responsibility or liability for cancellations, delays, changes or losses caused by Force Majeure and guests' injuries, illnesses, medical or psychiatric conditions developed during or subsequent to the Retreat; loss of/or damage to personal property of guests.
5.2 We do not accept responsible for expenses incurred in preparation for any cancelled trips by a guest such as airline tickets, or costs incurred due to travel delays or illness.
6. CANCELLATION
6.1 Cancellation of your holiday, for whatever reason, should be notified to us in both writing and confirmed in an email. All cancellations written and by email only come into effect when we contact you to acknowledge receipt of your cancellation .
6.2 Please note that the following charges will be applied accordingly:
(a) Up to 56 days before departure loss of deposit
(b) 55 - 29 days before departure 50% of total price
(c)30 days or less before departure 100% of total price
6.3 At the time of going to press, all the programmes listed will have been confirmed by the respective Course Instructors. If, for any reason, a Course Instructor becomes unavailable we shall do our utmost to replace them with a leader of similar qualities. Wherever possible you will be advised in advance of any alterations.
6.4 We will do our up most never to cancel a retreat, except for reasons of Force Majeure, Underbooking or for non receipt of the full purchase price from you.
7. BOOKING AUTHORISATION
Where a booking is made on behalf of several individuals who themselves do not complete the Booking Form, the booking is conditional on the person completing the Booking Form having written authorisation from all the named individuals to enter into this contract. The written authorisation(s) should be submitted along with the Booking Forms by post.
8. INSURANCE:
8.1 In order to participate in the Retreat, guests must have travel insurance, which must be confirmed on the Booking Form.
8.2 Insurance is essential and a condition of the contract.
8.3 We strongly recommend that our clients are covered by comprehensive insurance and do not undertake participation in the Retreat against medical advice. At a minimum the insurance cover should cover the costs incurred if you make a cancellation and the cost of assistance, including repatriation, in the event of an accident or illness whilst you are abroad. It is your responsibility to ensure the insurance you purchase is suitable and adequate for your particular needs, for example taking yoga classes, hiking,etc.
9. COMPLAINTS
9.1 If a problem occurs whilst you are on the Retreat it must be reported to the Manager, so that any problem may be remedied on the spot. You will be introduced to the Manager on arrival.
9.2 If the Manager cannot resolve the problem to your satisfaction, you should contact us so that we are given the opportunity to help.
9.3 If your complaint is not resolved at the time, you must write and email us within 28 days of your return quoting your original booking reference and giving all relevant information.
9.4 Failure to notify us within the period specified in paragraph 9.3 may hinder our ability to resolve your complaint and/or investigate it fully and as a consequence, any right to compensation you could have may be prejudiced.
10. PASSPORT, VISA AND HEALTH REQUIREMENTS
10.1 You are responsible for:
(a) ensuring that you have a passport valid for 6 months after departure;
(b) checking with the applicable Embassy or Consulate to see whether the destination(s) that you are visiting requires a visa, especially if you do not hold a passport marked & apos;British Citizen'.
(c) ensuring that you comply with applicable health requirements; and
(d) taking all necessary documents with you to gain access to any country or region which you visit.
(e) the Foreign and Commonwealth Travel Advice Unit may have issued information about your holiday destination. You are advised to check whether or not such information has been issued, on BBC (Ceefax) page 470 or on the Internet under the address "www.fco.gov.uk" prior to the commencement of the Retreat.
10.2 If you fail to do so, you will be solely responsible for any cost, loss or damage, which you or we incur, as a result of your failure.
11. BEHAVIOUR
11.1 It is your responsibility to ensure that you do not behave in a way which is inappropriate or causes offence or danger to others or which risks damage to property belonging to others during the Retreat.
11.2 We reserve the right to terminate any such guest’s place on the Retreat if their conduct is disruptive or detrimental to the enjoyment of other guests, or if their conduct may prejudice the reputation of Sanasuma with our suppliers or hotel owners.
11.3 We shall be under no liability for any costs incurred by such a guest as a result of our so doing. Any such guest will not be eligible for any refunds, payments of compensation and/or any reimbursement of any cost or expenses you may incur as a result of such termination. Further, any such person will be liable to reimburse us for any expenses we incur as a result of such termination.
12. DOCUMENTS
It is your responsibility to check any documents sent to you immediately upon receipt. If any details are incorrect you must advise us immediately.
13. SPECIAL REQUESTS
If you have any special requests you should inform us of these on the Booking Form we will endeavour to accommodate your requests but we cannot guarantee they will be met.
14. LIABILITY
14.1 You accept that you are participating in yoga classes at your my own risk. (If you are in doubt as to the effect and suitability of yoga on your medical condition, please consult your doctor.)
14.2 We have no liability for any loss, damage to your personal property or personal injury or death however incurred on the Retreat (including consequential loss e.g. loss of income) unless we have been negligent or we have misrepresented important information.
